Fiscal Court Special Meeting Minutes – March 4, 2019

The Special Called Meeting of the Boyle County Fiscal Court was held on the 4th day of March, 2019 at 10:00 a.m. Members present at the meeting were:

Ronnie Short

Others present at the meeting were County Treasurer Mary Conley, County Attorney Chris Herron, Fiscal Court Clerk Jeanine Sanders, Deputy Sheriff Chris Stratton, County Engineer Duane Campbell, Brenda Mitchell, Joseph Shewmaker, Evan Teague, Amber Swartzer, Bryce Perry, John Cocanougher, Steve Ramey, Rick Serres, Jennifer Kirchner, Ruby Cline-Eaton, David Camic, Phil Showalter, Tony Gray, Ernie Coulter and Bobbie Curd.

Judge Hunt called the meeting to order at 10:00 AM and declared a quorum.

Judge Hunt presented The City of Danville Resolution number 2019-02-25-03 to the Court for discussion.

Magistrate Gay offered two options to the Court: first option would be to continue the Parks Board under the direction of the City of Danville and Boyle County Fiscal Court jointly; second option would be with the Parks Board under the direction of the Boyle County Fiscal Court.

Magistrate Ellis submitted a document to the Court with suggestions for the Parks Board, new Director, Budgeting concerns and Growth of the Park.

After extensive discussions, Magistrate Ellis made a motion to maintain the original Ordinance (City of Danville Ordinance 1425 and County Ordinance 740.0) as written with language to assure that the Trails are taken care of and the Veterans Park is distinctly and separate and maintained to perpetuity, and one acre of Fairgrounds property, seconded by Magistrate Sammons.

Magistrate Caywood asked the Court to consider having the management and operations of the Parks to be moved to the City of Danville.

Magistrate Gay asked the Court to include an updated Funding Agreement in the Ordinance.

Magistrate Ellis made a motion to amend his original motion to remove the Veterans Park, Trails language, and acreage, seconded by Magistrate Sammons. All members voted in favor.

The amended motion to continue the Parks Board under The City of Danville Ordinance No. 1425 and the Boyle County Fiscal Court Ordinance 740.0 as it was written was made by Magistrate Ellis, seconded by Magistrate Short. Voting in favor were Magistrate Gay, Magistrate Short, Magistrate Cullen, Magistrate Ellis and Magistrate Sammons. Voting against were Magistrate Caywood and Judge Hunt. The motion was carried by majority vote.

Judge Hunt will send a letter to the City of Danville with the County response.

With no further business, Magistrate Sammons made a motion to adjourn, seconded by Magistrate Short. All members voted in favor. Meeting adjourned at 11:18 a.m.
